Rex Omar has revealed that he nearly gave up on the lawsuit he filed against Joy Industries Limited for using his intellectual property without his permission.
The Chairman of the Musicians Union of Ghana said he realized he could not give up because he had to fight for the right of musicians.
“It got to a point I asked myself ‘why should I even continue especially when they wanted to settle out of court’. But the most important thing is, this whole thing was for the industry, this win is for the industry so we’re able to send the signal to everybody, corporate Ghana who use people’s works and go scot-free. It’s the love of the industry that kept me,” he told MzGee in an interview.
A Koforidua High Court awarded singer Rex Omar GHc200,000 in damages after ruling that Joy Industries Limited infringed on his rights.
The legal battle that lasted fives years,started when Rex Omar sued the alcoholic beverage company for using his song without permission.
Rex Omar was also awarded GHc30,000 as cost by the Koforidua High Court.
The Chairman of the Ghana Music Rights Organization filed a suit against Joy Industries Limited in 2015 for using parts of his “Dada Dida” song to promote and advertise their product, Joy Dadi Bitters’ without his consent.
He later secured an interlocutory injunction restraining Joy Industries Limited from using his works.
Later, the court ordered directors, officers, agents and servants of Joy Dadi Bitters to stop any electronic media from playing the commercial immediately, pending the final determination of the case.
