Samuel Aboagye, the declared winner of the Obuasi East parliamentary election, has filed a judicial review application at the Accra High Court, challenging the Electoral Commission’s (EC) decision to conduct a second collation and declaration of results.
The lawsuit, which also names Patrick Boakye Yiadom as an interested party, seeks to nullify the second collation and declaration made by the EC on December 21, 2024. Aboagye argues that the EC’s actions are invalid and requests the court to declare them as such.
Aboagye, the NDC candidate, is urging the court to compel the EC to officially publish the results collated on December 8, 2024, which he claims confirmed his victory as documented in Form 1D, signed by all relevant parties. He also seeks an injunction to prevent the EC from releasing any results that contradict those recorded on the original Form 1D. Furthermore, Aboagye requests that Patrick Boakye Yiadom be restrained from presenting himself as the elected Member of Parliament for Obuasi East.
The plaintiff asserts that the Public Elections Regulations, 2020 (C.I. 127), do not authorize the EC to perform a second collation or declaration once official results have been announced. He emphasizes that Form 1D, which summarizes election results, serves as a binding agreement among candidates and should not be altered without mutual consent.
Aboagye maintains that he was duly declared the winner of the December 7, 2024, election and asserts that any party disputing the results should pursue legal avenues to challenge them.
The case is scheduled to be heard by the General Jurisdiction Court Two on December 31, 2024.
