Supreme Court rules in favour of Heath Goldfields Limited over Bogoso-Prestea Mine

The Supreme Court has dismissed an application by Future Global Resources Limited and Blue Gold Bogoso Limited to certiorari quash the ruling of a High Court dated March 20, 2025 in favour of Heath Goldfields Limited.  

The applicants also wanted the Apex Court to further order the High Court to assume jurisdiction and determine the application for judicial review before the court.    

A five-member panel presided over by Justice Amadu Tanko said having reviewed all the processes filed, “we do not think this application has any merit in law.”   

He expressed disappointment at the applicants’ persistence in seeking to overturn a High Court decision, questioning why Heath Goldfields Limited and the Minerals Commission were drawn into the matter.   

“We consequently do not invite the Interested parties to respond. The application is accordingly dismissed,” he added.  

Lawyers for the applicants relied on affidavit in support and statement of case, indicating they had nothing to add to the statement of case filed.  

According to lawyers for Health Goldfields, this marked the sixth consecutive legal defeat for applicants, since September 2024, when the then Minister for Lands and Natural Resources lawfully terminated their mining rights and approved the transfer to Heath Goldfields Limited.  

They said the Supreme Court’s ruling reinforces Heath Goldfields’ legal position and underscores the Ghanaian government’s commitment to transparent, fair, and accountable management of the country’s mineral resources.  

Heath Goldfields Limited emphasised its ongoing focus on responsibly operating the Bogoso-Prestea Mine, supporting national economic development, investing in local communities, and engaging stakeholders with transparency and integrity.  

Earlier in the year, the Supreme Court struck out the applicants’ initial application for want of prosecution.   

A subsequent request to relist the case also failed to convince the Court.   

The original application, filed in December 2024, sought to quash the Minister’s decision and secure an injunction preventing Heath Goldfields from taking control of the mine.    However, on March 20, 2025, Justice Yaa Onyameye Gyakobo dismissed the case as incompetent and improperly grounded.
